Our store is powered by Shopify, which enables us to deliver our Services to you.

Prices are subject to change without notice. The price charged will be the price displayed at the time your order is placed, as confirmed in your order confirmation email. Unless stated otherwise, prices do not include applicable taxes, shipping, handling, or import and customs charges.

All delivery timelines are estimates and are not guaranteed. CousCousCous is not liable for delays caused by carriers, customs processing, or events outside our control. Risk of loss and title for purchased items passes to you upon transfer to the shipping carrier.

All content on the Services, including but not limited to text, images, graphics, video, audio, trademarks, logos, and design, is owned by CousCousCous, its affiliates, or licensors, and is protected by applicable intellectual property laws.

CousCousCous's name, logo, and brand assets are trademarks of CousCousCous and may not be used without prior written permission. All rights not expressly granted herein are reserved.

CousCousCous uses Shopify to power its store. All transactions are made directly with CousCousCous. Shopify is not a party to any sale and is not responsible for any aspect of transactions, products, or services between you and CousCousCous. You expressly release Shopify and its affiliates from any claims, damages, or liabilities arising from your purchases with us.

Because our store is hosted on Shopify, certain data you provide may also be subject to Shopify's Privacy Policy. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF CERTAIN WARRANTIES, SO SOME OF THE ABOVE MAY NOT APPLY TO YOU.

TO THE FULLEST EXTENT PERMITTED BY LAW, COUSCOUSCOOUS AND ITS PARTNERS, DIRECTORS, EMPLOYEES, AFFILIATES, AGENTS, AND LICENSORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, PUNITIVE, OR CONSEQUENTIAL DAMAGES — INCLUDING LOST PROFITS, LOST REVENUE, LOSS OF DATA, OR REPLACEMENT COSTS — ARISING FROM YOUR USE OF THE SERVICES OR ANY PRODUCTS PURCHASED THROUGH THEM, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

You agree to indemnify and hold harmless CousCousCous, Shopify, and their respective affiliates, officers, directors, employees, agents, and service providers from any losses, liabilities, claims, or legal costs (including reasonable attorneys' fees) arising from: (1) your breach of these Terms; (2) your violation of any applicable law or third-party rights; or (3) your use of the Services.

We will notify you of any indemnifiable claim. We may assume control of the defense of such a claim at your expense but will not settle any claim that imposes non-monetary obligations on you without your reasonable consent.

Section 19 — Severability

If any provision of these Terms is found to be unlawful or unenforceable, it will be enforced to the maximum extent permitted by law, and the remaining provisions will remain in full force and effect.

Section 20 — Waiver & Entire Agreement

Our failure to enforce any provision of these Terms does not constitute a waiver of that right. These Terms, together with our Privacy Policy and any other policies posted on our website, constitute the entire agreement between you and CousCousCous regarding your use of the Services and supersede all prior communications or agreements.

You may not assign or transfer any rights or obligations under these Terms without our prior written consent. We may assign or transfer our rights and obligations at any time without notice.

These Terms are governed by and construed in accordance with the laws of the jurisdiction in which CousCousCous is headquartered. Both parties consent to the exclusive jurisdiction of courts in that jurisdiction.
